1. Use of Service

You agree to use ThreatSense (the "Service") only for purposes that are permitted by these Terms and Conditions and any applicable law, regulation, or generally accepted practices or guidelines in the relevant jurisdictions.

Permitted Uses:

• Analyzing content for potential threats as intended by the Service.
• Managing your user account and associated data.

Prohibited Activities:

You agree not to engage in any of the following prohibited activities:

• Using the Service for any illegal or unauthorized purpose.
• Interfering with or disrupting the integrity or performance of the Service or the data contained therein.
• Attempting to gain unauthorized access to the Service or its related systems or networks.
• Reverse engineering, decompiling, disassembling, or otherwise attempting to discover the source code of the Service.
• Using any automated system, including without limitation "robots," "spiders," or "offline readers," to access the Service in a manner that sends more request messages to the servers than a human can reasonably produce in the same period by using a conventional on-line web browser.
• Transmitting any worms, viruses, or any code of a destructive nature.

2. Analysis Results Disclaimer

The analysis results provided by our Service are generated using artificial intelligence and machine learning technologies. While we strive for accuracy, you acknowledge and agree that:

• Analysis results may not be 100% accurate and should not be relied upon as the sole basis for making critical decisions.
• The Service may occasionally produce false positives or false negatives in its analysis.
• Analysis results should be used as a tool to assist in decision-making, not as a definitive determination.
• You are responsible for verifying the accuracy of analysis results and making your own independent assessment.

By using our Service, you expressly acknowledge that ThreatSense, its directors, employees, partners, agents, suppliers, and affiliates:

• Make no representations or warranties regarding the accuracy, completeness, or reliability of analysis results.
• Are not liable for any decisions made or actions taken based on the analysis results.
• Are not responsible for any consequences arising from the use or interpretation of analysis results.

3. User Accounts

To access certain features of the Service, you may be required to create an account. You are responsible for maintaining the confidentiality of your account password and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security. We will not be liable for any loss or damage arising from your failure to comply with this section.

4. Intellectual Property

The Service and its original content (excluding content provided by users), features, and functionality are and will remain the exclusive property of ThreatSense and its licensors. The Service is protected by copyright, trademark, and other laws of Switzerland and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of ThreatSense.

5. Termination

We may terminate or suspend your access to our Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service, or contact us to request account deletion. All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

6. Disclaimers

YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK. THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. THE SERVICE IS PROVIDED WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

THREATSENSE, ITS SUBSIDIARIES, AFFILIATES, AND ITS LICENSORS DO NOT WARRANT THAT A) THE SERVICE WILL FUNCTION UNINTERRUPTED, SECURE, OR AVAILABLE AT ANY PARTICULAR TIME OR LOCATION; B) ANY ERRORS OR DEFECTS WILL BE CORRECTED; C) THE SERVICE IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS; OR D) THE RESULTS OF USING THE SERVICE WILL MEET YOUR REQUIREMENTS.

7. Limitation of Liability

To the maximum extent permitted by Swiss law, ThreatSense, its directors, employees, partners, agents, suppliers, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses.

Nothing in these Terms shall limit or exclude our liability for:

• Death or personal injury caused by our negligence
• Fraud or fraudulent misrepresentation
• Any other liability that cannot be excluded or limited under Swiss law

8. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with Swiss law, without regard to its conflict of law provisions. Any disputes arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Switzerland.

For consumers residing in Switzerland, these Terms shall not deprive you of the protection afforded to you by provisions that cannot be derogated from by agreement by virtue of the law which, in the absence of any choice, would have been applicable.

9. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Service.
